The plain-English terms.

These terms cover kddesignco.com and the websites KD Design builds and hosts. KD Design is the business name of KD Trading LLC, Bellingham, MA ("KD Design", "we"). When you sign up for a plan, you also sign a written agreement for that plan. If anything here differs from your signed agreement, the agreement wins.

Free demos

We may build a free demo of your website from your current site, Google listing, photos and reviews, so you can see it before you decide anything. A demo costs nothing and you owe nothing if you don't go ahead. Demos are not listed on Google. If you'd like a demo of your business taken down, email hello@kddesignco.com and we'll remove it.

Plans and the 12-month term

Every plan (Spotlight, Local Leader and Top of Town) runs for 12 months from the day your site goes live. What each plan includes is listed on our pricing section and in your agreement. Add-ons are only added with your OK in writing (email is fine).

Payments

• Paying a build fee: half the build fee is due when you sign, and the other half the day your site goes live. The monthly fee is charged to your card automatically each month for 12 months, starting the day your site goes live.
• Nothing down: there is no build fee. You pay the higher monthly price instead, charged automatically each month for 12 months, starting the day your site goes live.
• If a payment fails and isn't fixed within 14 days, we may pause the site until it is.

Timeline and what we need from you

We aim to put your site live within 21 days of getting what we need from you: your photos and logo (or a photo shoot), the facts we ask you to confirm, and access to your domain and Google Business Profile. The 7-day rush add-on shortens this. You confirm you have the right to use everything you send us.

Who owns what

You own your domain. Once the build is paid for, you own your site's design, words and the photos made for you. We keep the rights to our own tools and code, which we may reuse for other clients. We may show your site in our portfolio unless you tell us not to.

Hosting

Hosting, security and updates are included while your plan is active. We don't host email.

Our 90-day promise

Before we start, we agree on a starting point in writing: about how many inquiries (calls, texts and quote requests) your current website brings in each month. If your new site hasn't brought in more than that within 90 days of going live, as shown on your private results page, we keep working on it at no extra charge until it does. This is a promise to keep working, not a money-back guarantee. We never promise a Google ranking or a number of sales.

After the first year, or ending early

After 12 months you can keep everything running for $99 a month, month to month, or take your site files with you at no charge. If you end your plan during the first 12 months, the monthly fees for the rest of the 12 months are still due, unless we agree otherwise in writing. Limits

We work with care, but we aren't responsible for outages caused by others (internet providers, Google, Cloudflare) or for lost profits. Our total responsibility to you is limited to what you paid us in the 3 months before a claim.

The rest
